Art or tagging

This Simpsons character is on the back of my dance studio. I often walk past it and down the alley way beside it and wonder if this is art or tagging. I do know that there is a sign saying legal graffiti art. As this is on the back of my dance studio we do use it a lot for a photos so I guess it's creative. What do you think?
